Official Contest Rules

Eligibility

NO CONTRIBUTION OR PURCHASE IS REQUIRED TO ENTER OR WIN. A CONTRIBUTION OR PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

This contest is open to all adult residents of Oregon and Washington states. Employees of OPB, volunteer on-air hosts of KMHD, and employees of PBS, NPR, PBS or NPR member stations, corporate underwriters of OPB or KMHD, and their respective household or immediate family members, are not eligible to enter. Compliance with the eligibility requirements will be determined solely by OPB. All Federal, State and local laws and regulations apply. Void wherever prohibited or restricted by law. Entrants must provide a valid telephone number and/or email address.

Entries

All donors who make a contribution online at www.kmhd.org or by calling 1-877-564-5643 between 7:55AM May 3, 2010 and 6PM May 8, 2010 will be automatically entered into drawings for this contest. To enter without making a contribution, call 1-877-564-5643 during the applicable contest period and ask to be entered into the drawing without making a contribution. All times are in Pacific Standard Time. See below for specific prize package entry times. Limit of one entry per person. OPB is not responsible for lost, late, delayed or illegible entries or requests for entries. OPB assumes no responsibility for computer system, hardware, software or program malfunctions or other errors, failures, damages, delayed computer transactions or network connections, whether human, technical or otherwise in nature, in conjunction with this contest, participation or in connection with any prize acceptance. OPB, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or who is otherwise in violation of the Official Rules. Entrants agree OPB has the sole right to decide all matters and disputes arising from this contest and that its decision is final and binding.

Determination and Awarding of Prizes

OPB will select winners in several random drawings between May 3 and May 8, 2010. Winners will be notified by telephone and/or e-mail. Any prize not timely accepted by the winner will, in OPB's sole discretion, be forfeited for future use by OPB, returned to the prize donor, or awarded to an alternate winner. If a prize notification e-mail or any prize is returned to OPB or its designated agent as undeliverable, that prize will be awarded to an alternate winner. Prize packages will be awarded on an individual basis, with no more than one prize package awarded to each entrant.

Winners must confirm their acceptance of the prize by the date provided in the prize notification; otherwise the prize will be forfeited. Each prize is guaranteed to be awarded except if forfeited by a prize winner or in the possibility that OPB ceases operation, or for some other reason is unable to fulfill the prize after a diligent effort is made. In such circumstances OPB assumes no responsibility (monetary or otherwise) to fulfill the prize. Prizes are not redeemable for cash, exchangeable, or transferable. All taxes on prizes, including but not limited to Federal, State and local income and sales taxes, are the responsibility of the winners.

To obtain the Grand Prize, the winning entrant must provide proof of the correctness of entrant's information on the entry form and compliance with the terms and conditions contained in the Official Rules by signing an Affidavit of Eligibility, release of publicity and release of liability and returning the executed document to OPB.

Prizes:

First Drawing:

In this drawing, one (1) winner will receive four tickets to the Silverton Jazz & Wine Festival, held in Silverton, Oregon on Saturday, May 8, 2010. All entries must be received between 7:55AM and 8PM on May 3, 2010 only. The total fair-market value of the tickets is $100.

Each ticket includes $5 in scrip for food and drinks, a commemorative wine glass and a wrist band that allows access to all participating venues.

Second Drawing:

In this drawing, four (4) winners will each receive one pair of tickets to the Afro-Cuban All Stars performance at the Roseland Theater in Portland, Oregon on Thursday, July 15, 2010. The total fair-market value of a pair of these tickets is $44. All entries for this drawing must be received between 7:55AM, May 3, 2010, and 6PM May 4, 2010 only.

Third Drawing:

In this drawing, one (1) winner will receive an Apple iPad (approx retail value $499). All entries for this drawing must be received between 7:55AM, May 3, 2010 and 8PM, May 7, 2010 only.

Other drawings: All entries for the following prize drawings must be received between 7:55AM May 3, 2010 and a deadline that will be communicated on air. The deadline will not exceed 6PM, May 8, 2010.

The prizes for "other drawings":

Two (2) winners will each receive one $100 gift certificate to Wilf’s Restaurant and Bar in Portland, Oregon.

Two (2) winners will each receive one $150 gift certificate to The Brasserie Montmartre (restaurant) in Portland, Oregon.

Two (2) winners will each receive one $100 gift certificate to Jimmy Mak’s club in Portland, Oregon.

Grand Prize Drawing:

In this drawing, one (1) Grand Prize winner will receive one pair of "Blues Benefactor" passes to the Safeway Waterfront Blues Festival, July 2-5, 2010 and one pair of tickets to the Delta Music Experience "Sail on Sister" Cruise at 2pm on July 5, 2010. All eligible entries received between 7:55AM May 3, 2010 and 6PM on May 8, 2010 will remain eligible for the Grand Prize unless the entrant has previously been drawn as a winner in one of the other drawings held between May 3, 2010 and May 8, 2010. The total fair-market value of the passes and cruise is $490.

The "Sail on Sister" cruise boards from the seawall at SW Salmon and Naito Parkway, in front of McCall Fountain, just north of the A&E Front Porch Stage. The cruise will head south up the Willamette River to Oregon City, and/or north past the Port of Portland docks.

This cruise is open to all ages. Boarding is at 2 p.m. The cruise returns to the dock at 4:30 p.m.

Photo ID is required to board the Portland Spirit for all cruises. Exception: children 12 and younger do not need photo ID.

Odds of Winning

Odds of winning are determined by the total number of entries received and cannot be projected.Release and Indemnification

Entry constitutes permission for OPB (except where prohibited by law) to use winners' names, hometowns and likenesses for publicity purposes without additional compensation. By entering, all entrants agree to be bound by the contest rules and further agree to release, indemnify and hold harmless OPB, its licensees, affiliates, successors and funders, and their respective directors, officers, agents and employees from and against all actions, causes of actions and liability, including attorney's fees and costs, arising out of or relating to the entrant's participation in the contest and receipt and use or misuse of the prize awarded.

Choice of Law

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of OPB in connection with the contest, shall be governed by the laws of the State of Oregon without regard to the conflicts of law principles thereof.
