Attorney General John Kroger's office has discovered four boxes of evidence in the Philip Scott Cannon murder case. Two years ago, Cannon's conviction was overturned and he was granted a re-trial. That never happened, and Cannon was set free, since the evidence couldn't be found and was presumed to have been destroyed. The boxes were found Monday morning at the Trial Division of the Department of Justice.
In 1998, Cannon was convicted of the murder of three people in Polk County. He spent 11 years in prison and always maintained his innocence. When Polk County District Attorney and the DOJ dropped the charges, they did so "without prejudice," which allowed the case to be re-tried if the evidence was found. It is unclear whether that will happen. Polk County District Attorney Stan Butterfield said the case is now an open murder investigation but that he has no further comment at this time.
Today his son's Facebook page reads "NOT a good day. Here we go ... again?" Kroger has called on Oregon State Police to investigate the mishandling of the documents.
