A jury unanimously found that Ricardo Serrano should be put to death for murdering Melody Dang and her two sons. Washington County Circuit Court Judge Steven Price will formally sentence Serrano on Tuesday. Serrano is poised to become the 33rd man on Oregon's death row. If history is any guide, he'll be likely to stay there for a while.
The modern age of Oregon's death penalty began in 1984, when capital punishment was reinstated, but there have only been two executions since then. Douglas Franklin Wright was executed in 1996 for killing three homeless men in Central Oregon. Charles Moore was executed a year later for murdering his half-sister and her ex-husband. Both of these executions were, in a sense, voluntary: the convicted men gave up their appeals.
For men on death row (pdf) — and right now they're all men — who do appeal, the process is very different. Appeals, at multiple levels of state and federal courts, can take decades.

I would like to clarify the pdf link in the article that is about the men on death row. The pdf shows only one man on death row since 1989. However, Oregon's 1984 death penalty law had to be changed in about 1991, adding a fourth question, and 23 men were resentenced. Twelve of the men were resentenced to life. One man died of cancer. For 8 other men listed in the pdf, who were again sentenced to death, the Department of Corrections puts the date of their last sentencing, not the real "Begin Date" for how long they have been on death row. Three of those men have been on death row since 1988 and five since 1989. Another of the men from 1988 had his sentence changed to life without parole last summer.

I could not agree more! Foster homes, broken families, drug abuse, failure of our education system...it is all signs of the failure and destruction of our society.
If we would spend half the money we do on Oregon's prison complexes (I think there are like 14 prisons in our state now) on schools, our crime rate would decrease.

Half the comments on the Oregonian article of 3/11 on the Serrano verdict made highly vitriolic statements about killing criminals who committed heinous crimes. Justifiable Homicide, another expression for societal Vengeance, seems to be the only logical argument that remains when you properly weigh the fact that innocent convicts have been and are sure to be executed, and that it costs more to convict and execute than to house these murderers for 40 years as life without possibility of parole. More than one commentator cited the biblical “an eye for an eye” quote. We should consider another quote by Gandhi: “An eye for an eye ends with a world of blind people.” Surely we can replace the Old World vengeful God with the New Testament respect for life espoused by all religions.

Once the jury has reached a verdict there should we a time-frame when the execution has to be carried out. If there is an appeal they should prioritize such cases and come to a decision at the earliest instead of it being dragged on for years which is additional expense on the exchequer! Just this past weekend I visited a death row inmate for the first time. I had never met him except through correspondence and prayer. He began praying daily for my 17 year old son after he attempted suicide last October. We learned of him through the hospital chaplain who visits the inmate weekly, and every week Jeff, the inmate, asks "who can I pray for this week?"
During his 15 years on death row, this former white supremacist has raised over $100,000 for poor women and children in Darfur through "The Bakhita Project," an endeavor he and the chaplain began. He has written more than 14,000 "beggar letters" from his cell, as he calls them, where he talks of the situation in Darfur and then "God moves people's hearts and they give."
I have always been anti-death penalty on principle, and now it has become personal for me. As my husband and I say, whether it is about addiction or depression or living on death row, "As long as there is life, there is hope."

As someone who works with the accused, I have learned to never judge a person by their single worst act of their life. Oregon wastes a lot of money on indictments for the death penalty that are never intended to be pursued as "death cases", it is used as a negotiation tool to obtain life sentences in order to save a client's life.
To quote my favorite bumper sticker" Why do we kill people who kill people to teach people that killing people is wrong?"
It does nothing for deterrence, I have yet to meet a client who said "gee before I did this I thought I might get the death penalty".
My clients are always poor, usually a minority and frequently suffer from mental illness and/or mental retardation (note that two men have been released from death row this year in Oregon due to failure to mitigate at the trial level issues relating to mental retardation).

After spending much of my working life on the continent (Liberia, Uganda, Somalia) where the progenitors of many of the most violent of our killers originate I am intriged by the observation that so many of the killers are border line retarded and thus perhaps should be judged less harshly.
That is like saying most Asians have black hair. In my experience a propensity toward mindless cruelty and a general inability to control muderous impulses is a common trait among these people. If you haven't spent much time working in Africa my comment will no doubt strike you as extraordinarily un PC. We are all captive to our life's experiences.

I had the unique opportunity to see the part of Oregon State Prison that houses death row inmates while working on a documentary about the prison. I was surprised to see Christian Longo, among other deathrow inmates, seemingly comfortable and not confined to a small cell like "regular" inmates. The death row inmates had a heavily secured, open area they are allowed to be in. When I asked our guide, about this (he as a fairly high ranking prison official), he made a point I had not thought of, which I will paraphrase... these (deathrow) inmates are not here (in the prison) as punishment. Their punishment is death. So in some ways, the housing terms are a in some ways better.
By no means was it "cushy," but it wasn't what I had pictured in my mind.

Absolutely they express remorse for their victims, their victims families and for the pain they have caused to their own families (remember, they are sons, brothers, fathers, husbands, too). They are, after all, human.

Regarding today’s THINK OUT LOUD program about “life on death row”………
First, I want to commend Supt Jeff Primo on his expressed attitude of respect toward those residents of Oregon’s Death Row. He obviously is doing his job of keeping convicted people separated from the general population, but not focused on making their live as miserable as they can be.
Second, I totally disagree with the caller, who described life on death row as “the life of Reilly”. I have visited an inmate on death row, as well as visiting inmates at three other DOC institutions…..in my opinion none of these people have a life of Rielly….if someone thinks that this is a desirable life they should try to stay in their bedroom for 22.5 hours a day and stay in their house or yard the rest of the day. Once in a while, maybe, for long periods of time, very doubtful that they would consider it a life described as anything favorable.
My final comment would be that the Dept of Corrections has proven that they can keep not only citizens, but prison workers, safe from people who are convicted of violent crimes. The citizens of Oregon are spending literally millions of dollars on a death penalty system that is not necessary. There are alternatives to a death penalty that work, are less expensive, provide safety for the rest of us, and punish people by taking away their freedom, which those of us on the outside take for granted. At a time when Oregon and every other state struggles with its fiscal problem Oregon should seriously consider repealing the death penalty.

Not sure I understand why the rest of us are supposed to show toward these convicts a consideration killers never display toward their victims? We spend more tax money keeping these merciless people alive on death row than their lives are worth to anyone.
Perhaps none of you have noticed but we are a society slowly sinking toward the hard reality most of the planet suffer. Warm, fuzzy angush over convicted killers will soon enough be a hand wringing endulgence we can't afford.
Lawyers, sociologists, psychiatrists, Do Gooders poke, prod and feed off the killers for decades, while the rest of us see our hard earned (coerced) taxes keeping the condemned locked up and cared for long enough in some instances for them to die of natural causes. Allowing them endless access to appeals courts is silly and costly. One appeal and then execute them.

I, too, appreciated the superintendent's position. I also agree with the fact these men are not living the "life of Reily". To hear the corrections officer (female) and the author speak, they have dinner parties and pruno parties. My concern now is that a massive toss of their cells will happen because of the pruno statement.
Some of these people did do horrid crimes. Some of them were in the wrong place at the wrong time and had poor trial representation. Yes, we spend a lot of money making sure that their sentences are just, fair and correct We are, after all, a country of laws. I believe that the 125 people (or more, I don't know the exact number anymore) who have been freed for actual innocence would agree, the money is well spent.
Was it right in Texas when there was clear and convincing evidence of innocence that the governor still ordered an execution? Remember, our laws are "our" laws, we all own them, so the execution of an innocent, or a mentally incompetent person, is something we do.

In public health, unless the numbers affected by a an communicable outbreak rise to a certain percentage, the US Public Health Service does not order draconian measures to deal with it. This means that an unknown number of people will lose their lives because some public health measures were not enacted or enforced. No one knows that number. But there is no question it is many times greater than the relative handful of wrongly executed inmates.
In both cases public policy issues boil down to money, priorities and return on investment. It is an imperfect world. Not every wrong can be righted at a cost commensurate with result.

There's no place for death row in our civilized society. Reconciliation is long lasting and effective in helping a perpetrator of violent crimes make amends. It takes courage to create this kind of peace and it's the only real and lasting solution.
We need to model Nonviolent Living and develop new patterns of working out our differences. Many of us call ourselves a "Christian" nation when it's convenient to be Christian. But when the rubber hits the road, we turn again and again to violence. Where in the Bible does Jesus model that approach?
We need to give our children a new legacy of respect and strength to dialogue and move beyond our limitations of prejudice, fear and conditioning.

If this person was found quilty of his crime, then he should be put to death. There should be no chance for any kind of appeals. Our goverment should not allow that to happen. This person killed 3 people in cold blood, and that is the fact, so why would the court or any judge allow for any appeals??? Our count system is really bad, especially when it costs us, the tax payers, million dollars, that can be used for something more important, than appeals.

This is really sad to see that people are being put to death. You have to consider what these people have done to others which is usually very horrible. Also you have to consider what the state has to pay to house these inmates. Most people dont realize the cost associated with prisions. These are some tough questions.

Death Row is no place for anybody but how can we argue these people don't deserve it when they have in most cases taken someones life?
I am sure the individual will pay for his crimes but is Death Row and the Death penalty justice or would it be better to keep this person alive and make them suffer? The families have to live with the pain of a family loss for the rest of their lives so why shouldnt he?

All I have to say is "God help us" if we start putting people to death which were innocent. I read this article at the office and then, when riding home on my 2009 Harley-Davidson Rocker C, I started thinking about being strapped to a table for lethal injection and knowing that you were being killed in error just sets my teeth on edge.

An excerpt from AP story by Matt Leingang on the Ohio Death row inmate, Lawrence Reynolds, who tried to commit suicide just before he was executed:
It's rare, but not unheard of, for condemned inmates to attempt suicide as they approach execution dates, said Richard Dieter, executive director of the Death Penalty Information Center, a group opposed to capital punishment.
California has executed 13 inmates since capital punishment was reinstated in 1978 - a period during which 17 condemned inmates committed suicide.
Nine condemned inmates in Texas have committed suicide since death row reopened there in 1974. The last, William Robinson, 49, used a sheet to hang himself in his cell at a psychiatric center in February 2008
Many lifers and death row inmates would just as soon end their lives and get it over with. It is time to begin considering suicide as a valid option. Our prisons are overcrowded and it is a pretty miserable life to live for 50 years or until your appeals expire. Can we devise a system of annually offering voluntary euthanasia to all long term offenders. A simple, self-administered pill that would end their suffering without the hoopla and expense of a formal execution. Should voluntary euthanasia be a lawful option for inmates?
