California's Proposition 8 to ban same-sex marriage was struck down Tuesday by a panel of the 9th Circuit Court of Appeals. But everyone understands that this is not the end of the road. Appeals come next. And more discussion.

And it's also spurred discussion here in Oregon where the passage of Measure 36 in 2004 also meant a ban on same-sex marriage. Measure 36 made it's way through a series of state appeals and was ruled constitutional.

They may sound similar, but there are a few distinct differences between California's Prop 8 and Oregon's Measure 36. Prop 8 was not a state constitutional amendment. It was challenged in federal court. Also, in California, a number of the same-sex marriages that were performed before Prop 8 was passed were deemed legal. In Oregon, the same-sex marriages that happened before Measure 36 were deemed not legally valid.

In this show we'll find out what — if any — legal repurcussions from the Prop 8 ruling we can expect in Oregon.
