Of course we need to coloe the budget gap. Doing that with bad legislation is not the right thing. This Measure 66 tax is similar to the much-maligned Alternative Minimum Tax (AMT) in that it is not referenced. Referencing would consist of having this proposed tax be X% times the Oregon median income. That number could be set to equal $125,000 in 2010 dollars. Failure to do that turns this tax into a ticking time bomb. We need to do better.

on Time to Bail?

If these companies can raise debt financing from the private sector then they should do that. If they want each American household to invest $7000 in their companies then they need to dilute their stock and share ownership. You don't get risky investment money without sharing in the future benefit.

What makes it an issue specific to open source is that the OSLA itself is the defense for theft. Some developers may mis-appropriate code or concepts, bury it in open source, re-distribute it and now claim that they have done nothing wrong. It is the nature of the OSLA itself that causes this to be an interesting legal issue.

There is an important issue in open source. Some developers may incorporate code or intellectual property that is owned by someone else. Then they hide behind the open-source agreement saying they have done nothing wrong. There are lawsuits in the open-source community over this issue. Could we include this in the discussion today?
